ARTICLE 2- SUBJECT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts, regarding the sale and delivery of the product ordered electronically by the BUYER from the SELLER's website, with the characteristics and sales price specified below.

ARTICLE 4- GENERAL PROVISIONS

4.1- The BUYER declares that they have read and are informed about the basic features of the product subject to the agreement, the sales price, payment method, and delivery information on the website, and have confirmed these electronically.

4.2- The product subject to the agreement shall be delivered to the BUYER or the person/entity at the address indicated by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's location, and not exceeding the legal period of 3 days for each product.

4.3- If the product subject to the agreement is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if the recipient refuses to accept the delivery.

4.4- The SELLER is responsible for delivering the product subject to the agreement intact, complete, in accordance with the specifications specified in the order, and, if applicable, with warranty documents and user manuals.

4.5- For the delivery of the product subject to the agreement, the signed copy of this agreement must be delivered to the SELLER and the payment must be made in the manner chosen by the BUYER. If, for any reason, the payment is not made or canceled in the bank records, the SELLER shall be deemed free from their obligation to deliver the product.

4.6- After the delivery of the product, if the BUYER's credit card is used unlawfully or without authorization by others, not due to the BUYER's fault, and the relevant bank or financial institution does not pay the product's price to the SELLER, the BUYER must return the product to the SELLER within 3 days, provided it has been delivered to the BUYER. In such a case, transportation costs shall be borne by the BUYER.

4.7- If the SELLER is unable to deliver the product subject to the agreement on time due to force majeure or extraordinary circumstances such as adverse weather conditions or interruptions in transportation, the SELLER is obligated to inform the BUYER of the situation. In this case, the BUYER may choose to cancel the order, request the replacement of the product with its equivalent, or extend the delivery period until the impediment is resolved. If the BUYER cancels the order, the amount paid will be refunded within 10 days in cash and in full.

4.8- Products that are defective or faulty, whether sold with or without a warranty certificate, may be sent to the SELLER for necessary repair within the warranty terms. In such cases, shipping costs will be covered by the SELLER.

ARTICLE 5- RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the agreement within 7 days of the delivery of the product subject to the agreement to the BUYER or the person/entity at the indicated address. To exercise the right of withdrawal, the BUYER must notify the SELLER via fax, email, or phone within this period, and the product must be unused in accordance with the provisions of Article 6. Upon exercising this right, the invoice and shipping receipt for the product delivered to the BUYER or the third party must be returned to the SELLER. Within 7 days of receiving these documents, the product price will be refunded to the BUYER. If the original invoice is not returned, VAT and other legal obligations cannot be refunded. Shipping costs for the returned product due to the right of withdrawal will be covered by the SELLER.

ARTICLE 6- PRODUCTS NOT ELIGIBLE FOR THE RIGHT OF WITHDRAWAL

Products that cannot be returned due to their nature, single-use products, copyable software and programs, perishable or expired products are not eligible for the right of withdrawal. The right of withdrawal for the following products is conditional upon the product's packaging not being opened, damaged, or used:

Portable Computers (cannot be returned after the original operating system is installed).
All kinds of software and programs.
DVDs, VCDs, CDs, and cassettes.
Computer and stationery consumables (toner, cartridges, ribbons, etc.)
All kinds of cosmetic products.
Phone credit orders.

ARTICLE 7- AUTHORIZED COURT

In the implementation of this agreement, Consumer Arbitration Committees up to the value announced by the Ministry of Industry and Trade and Consumer Courts at the BUYER's or SELLER's location are authorized.

Upon order placement, the BUYER is deemed to have accepted all terms of this agreement.
